Access Gym Ltd is committed to providing clear, transparent and fair membership terms. This Refund & Cooling‑Off Policy outlines the circumstances under which refunds may be issued and the rights of members depending on how their membership was purchased.

1. Online Membership Purchases (Distance Contracts)

Memberships purchased online, whether via our website, mobile device, or any other off‑premises method, are covered by the Consumer Contracts Regulations 2013.

Accordingly, all online membership purchases include a 14‑day statutory cooling‑off period.

During this 14‑day period, members may cancel their membership for any reason and will receive a full refund of all fees paid, provided that cancellation is requested within the cooling‑off window. Refunds will be processed using the original payment method within a reasonable timeframe.

If a member chooses to begin using the gym during the cooling‑off period, Access Gym Ltd reserves the right to deduct a proportionate amount reflecting the services already provided prior to cancellation, as permitted under the Regulations.

2. In‑Person Membership Purchases (On‑Premises Contracts)

Memberships purchased in person at Access Gym Ltd are classed as on‑premises contracts. These purchases do not fall under the statutory cooling‑off provisions of the Consumer Contracts Regulations 2013.

For this reason, all in‑person membership purchases are strictly non‑refundable once the transaction has been completed. By completing an in‑person purchase, the member acknowledges and accepts that the membership is a fixed commitment for the agreed term.

3. Non‑Transferability of Memberships

All memberships purchased at Access Gym Ltd—whether online or in person—are non‑transferable. This means memberships cannot be reassigned, gifted, sold, or otherwise transferred to another individual under any circumstances.

4. Exceptional Circumstances

Access Gym Ltd may, at its sole discretion, consider refund requests outside the above criteria only in exceptional situations, such as serious medical conditions that prevent ongoing use of the facility. Evidence may be required, and approval is not guaranteed.

5. Clarity of Terms

By purchasing a membership, members confirm that they have read, understood and agreed to the terms of this Refund & Cooling‑Off Policy. Access Gym Ltd reserves the right to update or amend this policy at any time, and any changes will be published on our website.
